Dispute Resolution - Mediation and Arbitration

Employment The challenging aspect of employment cases are handling the emotions of the parties. Ms. Moreno is very adept at handling emotion. Since Ms. Moreno has years of experience litigating employment cases she understands the legal issues very well. She holds ADR contracts with the US Forest Service and US Postal Service and mediates the litigated employment cases.

Administrative Hearing Officer Ms. Moreno hears administrative hearings for various governmental agencies: Housing Authority of the County of Los Angeles, Los Angeles County Employee Retirement Association (LACERA), Los Angeles Department of Water and Power, City of Long Beach, and the City of Santa Monica. The cases that come before Ms. Moreno range from HUD Section 8 housing violations, disability retirement issues, water and gas disputes to municipal code violations.

Construction Construction Cases are complex because there are many stakeholders: owners, developers, general contractors, subcontractors, insurance carriers and sureties. Since a hallmark of Ms. Moreno is organization, she manages the numerous parties, which enables her to get to the facts and work toward a practical solution.

Business Disputes Business disputes are unique because the parties do not go in separate directions after the resolution of a lawsuit. The parties will continue to have dealings and compete in the same market. The preservation of the good reputation of a business leads to its success. Ms. Moreno focuses on the critical issues and interests of each party keeping in mind that each party will continue in the same business.

Personal Injury The position of each side of these disputes are diametrically opposed. Plaintiff's perspective is to maximize their recovery. Defendant wants to conclude the matter within their settlement evaluation. Insurance carriers who insure a defendant justify their settlement value after assessing the risks, participating in round tables and getting authorization from supervisors. Their goal is to conclude the matter within their settlement authority. The driving force in getting the parties to an acceptable settlement amount is that each fears that at trial they have the risk of a worst result.

Real Estate These are cases where preparation is essential in receiving documentation prior to the mediation and understanding the facts. The parties will interpret the documents and facts to their own advantage and will be greatly at odds with one another. These cases can be very emotional because other issues are fueling the dispute, not just the piece of land.

Special Education Ms. Moreno has knowledge and experience mediating issues involving special education including Denial of Free Access to Public Education (FAPE), reimbursement for educational services under IDEA, parent's right to obtain an Independent educational evaluation (IEE), failure to fully implement the student's Individualized Educational Plan (IEP) and Least Restrictive Environment (LRE) issues.

Fees

Mediation: The hourly rate is $350 per hour. The full day rate (8 hours) is $2500. If a party is assigned through the Riverside or Orange County Superior Courts, the fees posted on the court's mediator list will apply.

Arbitration:The hourly rate for arbitration is $350 per hour.

Locations: Ms. Moreno will travel within the greater Los Angeles, Orange, Ventura, Riverside and San Bernardino County areas. If you do not have a facility available to hold the mediation or arbitration, Ms. Moreno will ascertain a convenient location.
