Successful Results

A few examples of those successful client results are listed here.

Slip and Fall
A 62 year old office manager and therapist sustained serious injury to her left elbow when she tripped and fell walking out of a medical office into a parking lot. Plaintiff underwent two surgeries. Medical bills totaled $35,000. Ms. Moreno represented plaintiff at arbitration where plaintiff was awarded $175,000.

Defamation and Slander
Ms. Moreno successfully defended an insurance agent in a defamation and slander action. Plaintiff claimed that his insurance agent defamed him and caused his publicly traded health supplement corporation to fail. Plaintiff demanded $15 million before trial. Defendants offered $3 million, which was the cost to take the action to trial. After a two month trial, the Jury awarded only $1 million, which all went to plaintiff’s costs and attorney fees.

Sexual Harassment/Hostile Work Environment
Ms. Moreno successfully defended an ethnic origin and religious discrimination claim on behalf of an employer law firm. Plaintiff claimed that she was discriminated against because she was not Jewish and that she was refused the day off to observe a Persian holiday. The court granted defendants Motion for Summary Adjudication and shortly thereafter the case settled in the very low five figures.

Medical Malpractice
Plaintiff, a building contractor, underwent arthroscopic knee surgery by defendant. When defendant was removing the dressings with a scalpel, defendant lacerated plaintiff's calf causing damage to his saphenous nerve. As a result plaintiff suffered from chronic pain syndrome. Ms. Moreno, representing plaintiff, tried the case and the verdict is the highest awarded in the nation for a saphenous nerve injury.

Auto Accident
Ms. Moreno represented plaintiff who was a taxi cab driver and was struck while defendant's employee ran a red light. Plaintiff suffered permanent cognitive brain damage resulting in a permanent disability and reducing his earning capacity. Ms. Moreno obtained a favorable settlement for plaintiff in the amount of $2 million dollars.

Breach of Insurance Contract and Fraud
Plaintiff rear ended two vehicles. Plaintiff claimed that even though the vehicle was not list on her policy, she had acquired it within the last 30 days and therefore had coverage. Ms. Moreno represented the insurance agent and discovery revealed that plaintiff falsified documents and that she did not request insurance for the vehicle until more than 30 days after the accident and after acquiring the vehicle. The jury's decision was 8-4 in favor of defendant on breach of contract and 12-0 in favor of defendants on the fraud cause of action. The case was subsequently dismissed by plaintiff.

Unfair Competition Class Action
Plaintiff, as a representative class member, brought an unfair competition class action lawsuit against a 1200 employee valet parking company alleging that the employer was taking the employees tips. Ms. Moreno successfully defeated the action from being certified as a class action. Shortly thereafter, the case settled for very little.
